Unauthorized Internet Streaming Would Be a Felony Under New Bill

You know when your favorite show or an extremely important sporting event is airing, and you’re stuck at a place with your computer, Internet access, and a significant lack of cable television, and you just mosey on over to your favorite Internet streaming site and stream it live? Well, if a new bill introduced late last week becomes law, said streaming would be upgraded to a felony.

As Ars Technica points out, “reproducing” and “distributing” copyrighted works are felony charges, but the streaming of content was never classified as such because it was considered a “public performance,” something that wasn’t considered distribution. However, under the new bill, introduced by Senators Amy Klobuchar (D-MN) and John Cornyn (R-TX), “public performance” would join “reproducing” and “distributing” copyrighted works as a felony. Online streamers would face up to five years in prison, and can be charged a fine if they are caught showing ten or more “public performances” via electronic means in any 180-day period, as well as if the total retail value of said “public performances” reaches over $2,500 or the price of licensing a single “public performance” breaches the $5,000 mark.

    I may be going out on a limb here, and I don’t claim to know how our
    government works, but I *believe* this bill would actually have to pass
    both houses and not be vetoed by the president before it would actually
    become law and your headline (and much of your story) would be true.  But thanks for your (apparently ironic) use of “I’m Just a Bill” art!

     CRZ is absolutely right. Bills are proposals and are introduced by the bucketload; only a relative few of them become actual laws.

     Just because of this reason, Blogger was banned in Turkey a few months ago. The TV channel that broadcasts national soccer league went to the court because Blogger didn’t shut down the blogs that contained live streams of national league matches. The ban is gone now, but it was a pain in the butt for all Blogger users.

     Bills a bill not a law, as others have said on here.  Regardless, Pirates have been crafty bastards for ages, so even if it is a felony to air more than 5 things in a 180day span, all they do is constantly create websites and just keep one for links, it will never, I REPEAT NEVER, be a felony to link to another website, I don’t care if you’re linking to a porn website on an elementary school forum.  Jail time will never be met because you are not the host! school forum.  Jail time will never be met because you are not the host!

    this bill will not pass because the U.S Senator’s are behind this, and the Supreme Court has said that Youtube is harmless, and gave them approval. I buy video games, and find that this bill will not pass, all they should do is charge a small monthly fee. I know it sounds stupid but the only reason this shit isn’t happening is because of how many people are voting against it in letters to the Government.This bill will fail.

    S.978  has nothing to do with uploading or streaming copyright infringements unless you are doing it for “commercial advantage or private financial gain”, which would have already made it a federal felony. 18 USC § 2319. Do your homework.
